4th & 5th Amendment Apply to Dorms Thanks to Attorney Wright & Attorney Diaz
April 2016
Police overstepped their bounds by disregarding the 4th and 5th Amendments' protections for residences on college campuses. They used another student to gain entry and conducted a warrant-less search of a dorm room without any emergency. Attorneys Diaz and Wright fought back, asserting that dorms, like all homes, are protected by the US and Texas Constitutions' privacy rights. They argued this case through the trial court, the court of appeals, and ultimately the state's highest criminal court, the Criminal Court of Appeals. The court sided with Diaz and Wright, resulting in the dismissal of charges against the young college student.
